licensing, what license is empires covered under ? also could i get the source models for infantry for empires?
Every license ever made is based on copyright law. You can only get what we have (low-poly) because Duke disappeared in the wild with high-poly versions.
Out of curiosity are the particles technically mine, valve's or krenzo's? I don't really care either way but I'm curious to know.
Most likely its your intellectual property also no developer has signed some contributer agreement that transfers the rights to a single entity. Maybe we should still do that to at least keep the way open if Empires should ever some day have a chance of going commercial.
i want to suggest a licensing thing: Empires stays proprietary copyrighted game, but 5 yeas from now if the game has not gone commercial have all the sources and resources like art and so on be freely available to all contributors for a non-commercial share alike thing. even if you dont want to do this i suggest that several of the "head devs" have every source and resource related to empires. this answer that "some-dude never gave us the resource models for infantry and now we only have these shitty modes" is just not good enough - with answers like that nobody would ever want to invest money into your development team.
Empires' license requires that upon my death I am to be buried with all source files, and all other copies are to be deleted.

I don't think they practically belong to anybody, as you aren't going to be able to enforce your ownership even if they were yours.

Wouldn't any contributions to "Empires" belong to itself as the copyrighted entity and krenzo owns the rights to empires? Also, Empires itself is subject to the terms and agreements of using the Source (tm) engine SDK. If it isn't protected in part or in whole by Krenzo's copyright, it would then fall under the intellectual property rights of valve.
Considering what happened to Firearms with the Firearms 2 fiasco, I'm not sure if anyone owns anything with mods.
